Terms & Conditions

This website is operated by The Business Hive Limited. Throughout the site, the terms “The Business Hive”, “we”, “us” and “our” refer to The Business Hive Limited.

The Business Hive offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or proceed booking through us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, nomads, and/ or contributors of content.

The Business Hive Limited is a membership-based coworking space and community. Both members and non members may reserve and use some areas of The Business Hive space.

 

Privacy Policy

The Business Hive complies with the New Zealand Privacy Act 1993 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person). This policy sets out how we will collect, use, disclose and protect your personal information. This policy does not limit or exclude any of your rights. We may change this policy by uploading a revised policy onto the website. The change will apply from the date that we upload the revised policy.

We collect personal information from you, including your:

  • name

  • business name (if applicable)

  • contact information

  • computer or network details

  • interactions with us

  • billing or purchase details

We collect your personal information in order:

  • to verify your identity

  • to provide you with services and products

  • promote you and your business within our building and on our website, on an opt-in basis

  • to market our services and products to you, including contacting you electronically

  • to undertake credit checks of you (if necessary)

  • to bill you and to collect money that you owe us, including authorising and processing credit card transactions

  • to respond to communications from you, including a complaint

  • to conduct research and statistical analysis (on an anonymised basis)

  • to protect and/or enforce our legal rights and interests, including defending any claim

  • for any other purpose authorised by you or the Act.

Besides our staff, we share this information with:

  • any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to
    provide the website or other services and products in order to ensure that they are able to support the products and services that you use

  • a credit reference agency in order to credit check you

  • a person who can require us to supply your personal information in order to comply with regulatory authorities

  • any other person authorised by the Act or another law in order to comply with applicable law

  • any other person authorised by you

Providing some information is optional. If you choose not to enter your full name, business or billing information, email and a phone contact number, we will be unable to provide products and services to you.

We keep your information safe by storing it in a secure database and only allowing authorised people to access it.

We keep your information for one year after you cease using our products and services, at which point we securely destroy it by deleting your information from our digital systems and any other location it was used (e.g. signage).

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.

If you’d like to ask for a copy of your information, or to have it corrected, please contact us.

 

Confidentiality

You agree to keep confidential information private.

Except as part of the proper performance of your work, you will not directly or indirectly use, copy, share, or permit the use or copying of any confidential information owned by any other Member unless you get written permission.

Confidential information means all information owned by you that is not in the public domain, and which a Member reasonably regards as private. It includes, but is not limited to:

  • commercial agreement

  • trade secrets

  • information about financial affairs

  • business methods and systems

  • information and records about clients, potential clients, suppliers and employees

  • business strategies, including merchandising, budgeting, market analysis, pricing, advertising, products and services

  • computer software and data

  • other information not known to the public

The requirement for confidentiality applies at all times while you work from the premises, and after the contract has ended.

Breach of this Confidentiality Agreement may be considered serious misconduct and may result in the termination of the services.

 

Health & Safety

The Business Hive Limited and you will each meet their obligations under the Health and Safety at Work Act.

The Business Hive’s duties include:

  • providing and maintaining a safe working environment for Members and others in the workplace

  • providing and maintaining facilities for the welfare of you while at work

  • providing all necessary training and instructions to Members

  • making sure machinery and equipment is safe

  • making sure working arrangements are not hazardous

  • providing procedures to deal with emergencies

  • making sure health and safety Member engagement and participation processes are in place

  • consulting and cooperating with other businesses operating in the same workplace(s) to keep everyone safe and health

You will follow The Business Hive Limited’s health and safety rules and procedures. You will take reasonable care to look after your own health and safety at work, your fitness for work, and the health and safety of others. Examples of how you can take reasonable care include:

  • following all reasonable health and safety rules and instructions

  • participating in health and safety discussions

  • taking reasonable care that your actions (or inactions) do not cause harm, or risk of harm, to yourself or others

  • wearing all necessary personal protective equipment and clothing

  • adhering to all Ministry of Health guidelines regarding Covid-19

You will further follow The Business Hive Limited’s health and safety rules and procedures regarding Covid-19 which include:

  • not entering the premises if you have cold or flu symptoms, only returning if you have been officially cleared of Covid-19 or have been symptom free for 48 hours

  • ensuring all your visitors to site comply with the above

  • ensuring all your visitors to the site provide contact tracing information (including date and time of contact, full name, contact telephone number, physical address)
    either using The Business Hive’s contact tracing mechanism or your own (if needing to ensure visitor’s privacy)

  • cleaning and sanitising of your own desk space using the equipment provided (common areas are the responsibility of The Business Hive)

  • placing all food or drink related items in the dishwasher or the bin and ensuring visitors do the same so that no-one needs to touch anyone else’s items

You must report any potential risks, incidents and near misses so The Business Hive Limited can investigate and eliminate or minimise harm, or risk of harm.

Failure to follow reasonable health and safety rules may be considered serious misconduct and may result in the termination of the services.

 

Cancellation Policies

The following terms apply to space use payments, cancellations and refunds:

Memberships

All our memberships are billed on a month-to-month basis for the various plans we have.

A notice of cancellation is required in writing by email to admin@thebusinesshive.co.nz 30 days in advance (for example, if cancelling June 1st, written notice must be sent before May 1st).

We will be unable to process any refund if you choose to terminate your membership before the agreed duration of membership.

Monthly reservations are charged at the time of booking for the first full month or any prorated dates, and a security deposit (if required).On ending of tenure, any security deposit would be refunded.

Day passes are billed at the time of purchase and are activated at the time of entry into The Business Hive. Day passes are non-refundable under any circumstances.

Meeting Room and Workspace Reservations

You may cancel your booking for a full refund no less than 5 working days in advance of your booking.
The cancellation must be submitted in writing by email to admin@thebusinesshive.co.nz.
A 50% refund will be available for bookings cancelled less than 5 working days prior.
No refund is available if the reservation is cancelled within 24 hours before the start time.
No refund is available if the reservation is cancelled after the start time.

Event Hosts

If you are using The Business Hive as the venue for your event, you may cancel your event for a full refund at least 5 working days in advance of your event date.
The cancellation must be submitted in writing by email to admin@thebusinesshive.co.nz.
If your cancellation is received within the 5 working days prior to your event start date, then you will be refunded 50% of your event fees. No refunds or discounts are available once the event has begun.

Event Tickets

If you have purchased a ticket for The Business Hive sponsored event, workshop or other program, you may cancel your participation up to 5 working days before the start of the event for a full refund of the ticket price.

The cancellation must be submitted in writing by email to admin@thebusinesshive.co.nz.

If you cancel within 5 working days of the start of the event, you will receive a “credit” in the amount of the full price of the ticket.

This credit can be used for future programming, membership, meeting room reservations or any other service of The Business Hive.

Tickets are transferable to another party if the purchaser of the ticket is unable to attend the event.

If you have purchased a ticket for an event that is held at The Business Hive but is hosted by a separate party or organization, then you must contact that party directly regarding their refund policy.

The Business Hive is in no way responsible for the payment or refund terms for outside organizations holding events within our workspace.

Additional Cancellation Terms

If there is a complaint from either party, notice must be given to The Business Hive within 24 hours of the reservation start time.

A reservation is not officially cancelled until the guest receives a cancellation confirmation e-mail from The Business Hive Limited.

If the cancellation e-mail is not received, contact us.

We may cancel your membership with immediate effect if you have breached any terms and conditions of this agreement, or membership fees or other charges remain unpaid 3 days after the due date and such a breach is not remedied by you within seven days, after being notified by us.

There will be no refunds if you do not notify us as described above.
